{"id":1972,"date":"2024-02-01T10:54:26","date_gmt":"2024-02-01T16:54:26","guid":{"rendered":"https:\/\/grupodelavega.mx\/2024\/02\/01\/do-you-have-doubts-about-the-tax-obligations-on-the-sale-of-a-house-or-a-car\/"},"modified":"2025-09-17T19:32:16","modified_gmt":"2025-09-18T01:32:16","slug":"do-you-have-doubts-about-the-tax-obligations-on-the-sale-of-a-house-or-a-car","status":"publish","type":"post","link":"https:\/\/grupodelavega.mx\/en\/2024\/02\/01\/do-you-have-doubts-about-the-tax-obligations-on-the-sale-of-a-house-or-a-car\/","title":{"rendered":"Do you have doubts about the tax obligations on the sale of a house or a car?"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\"><strong>You should be aware that there are tax obligations with respect to these operations, so we will give you some recommendations below.<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>What are the considerations if you are selling your home?<\/strong><\/p>\n\n<div class=\"wp-block-media-text has-media-on-the-right is-stacked-on-mobile\"><div class=\"wp-block-media-text__content\">\n<p class=\"wp-block-paragraph\">If you are planning to sell your house, you should know that there is an ISR exemption, which means that you can sell your house without having to pay the aforementioned tax, but you should know that there are certain requirements that you must comply with in order to enjoy this benefit, which we explain below:<\/p>\n<\/div><figure class=\"wp-block-media-text__media\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"1024\" src=\"https:\/\/grupodelavega.mx\/wp-content\/uploads\/2024\/02\/pexels-thirdman-8470842-1-1024x1024.jpg\" alt=\"\" class=\"wp-image-1489 size-full\" srcset=\"https:\/\/grupodelavega.mx\/wp-content\/uploads\/2024\/02\/pexels-thirdman-8470842-1-1024x1024.jpg 1024w, https:\/\/grupodelavega.mx\/wp-content\/uploads\/2024\/02\/pexels-thirdman-8470842-1-300x300.jpg 300w, https:\/\/grupodelavega.mx\/wp-content\/uploads\/2024\/02\/pexels-thirdman-8470842-1-150x150.jpg 150w, https:\/\/grupodelavega.mx\/wp-content\/uploads\/2024\/02\/pexels-thirdman-8470842-1-768x768.jpg 768w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/div>\n\n<ul class=\"wp-block-list\">\n<li>In accordance with article 93, section XIX of the Income Tax Law, <em>individuals who sell their home may consider exempt (i.e., tax free) the income obtained from such transaction, up to the amount of 700,000 UDIs, which, as of January 2024, is equivalent to approximately $5,640,605.00.<\/em> If the price exceeds the aforementioned amount, the profit corresponding to the operation must be determined and the tax must be calculated. The value of the exemption includes both the construction and the land, provided that the land does not exceed three times the area covered by the construction; for the excess, the corresponding ISR must be paid.  <\/li>\n\n\n\n<li>However, in order to be able to apply the benefit of the exemption, there are other requirements that must be met, which are described below:\n<ul class=\"wp-block-list\">\n<li>The sale of the house must be formalized before a notary or notary public.<\/li>\n\n\n\n<li>The person selling the house must prove that it was his or her home, i.e., he or she must prove that he or she lived there, for example, with utility payments.<\/li>\n\n\n\n<li>In case of having sold another house, at least 3 years must have elapsed between the different transactions, otherwise, the exemption is not applicable, and the transaction will be verified by the notary public, in order to comply with the applicable tax obligations.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>What happens if I am in the business and\/or professional activities regime and I have my house as part of my fixed assets?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>When a person who carries out business activities wishes to sell his house, but has applied the investment deduction on the property, he must comply with the provisions of number 101 of the Income Tax Law<\/strong>, which states that the gain resulting from the sale of assets must be accrued.<\/p>\n\n<p class=\"wp-block-paragraph\">In this sense, it is necessary to be clear that fixed assets are the set of tangible assets (tangible goods) that are used for the performance of the activities of individuals and companies, which with the use of the same, demerit their value in the service of taxpayers, as well as by the passage of time. In the same vein, the purpose of the acquisition of this type of assets is to be used in the development of the taxpayers&#8217; activities, and not to be disposed of (i.e., to be acquired for the purpose of being sold or used to comply with obligations to third parties). It is for this reason that when an individual who carries out business and\/or professional activities must analyze whether in the development of its operation its fixed assets include its home, since as explained in the preceding paragraphs, the sale of the property would not enjoy the income tax exemption indicated in section XIX of Article 93 mentioned above.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>If my main activity is precisely real estate transactions, am I entitled to apply the exemption of Article 93, Section XIX of the Income Tax Law?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>The answer to this question is no<\/strong>, since as explained at the beginning of this informative note, the benefit applies once per property and at least in a period of 3 years of difference between each of the sale operations, in addition to proving that the property was the home of the person selling it.<\/p>\n\n<p class=\"wp-block-paragraph\">If the person carrying out the sale transactions has more than one real estate property as part of his assets, he must comply with the provisions of articles 120, 121 and 122, as of the second sale transaction in the same year, for the determination of the gain on the sale of real estate, the application of deductions that correspond to this type of transactions and, if applicable, the treatment in case of obtaining a loss in tax matters, respectively.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Now, what aspects should I consider if instead of selling my house, I want to sell my car?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">In the case of individuals who are <em>registered under the business and\/or professional activities regime<\/em>, we must also consider the provisions of number <em>101 of the Income Tax Law<\/em> to determine whether there is a tax gain on the sale of these assets, since, as they have been subject to investment deductions in the development of the taxpayer&#8217;s operations, they comply with the assumption set forth in the aforementioned article.<\/p>\n\n<p class=\"wp-block-paragraph\">If not,  <em>the sale is made, for example, by a person who is a salaried employee, he\/she is also entitled to an exemption, in accordance with paragraph b, of the aforementioned Article 93 of the Income Tax Law.<\/em>  which states that personal property, other than shares, partnership interests, securities and investments of the taxpayer, when in the calendar year the difference between the total sales and the proven acquisition cost of the goods sold does not exceed three times the value of the UMA, which means that the exemption for the gain obtained for the year 2024 is equivalent to $118,819.08. Now, it is necessary not to lose sight of the fourth paragraph of Article 126 of the Income Tax Law, since in the sale of personal property, such as cars, a provisional payment must be made for the amount resulting from applying 20% of the amount of the transaction and must be withheld by the buyer, if the buyer is a resident in Mexico or a foreigner with a permanent establishment in Mexico, being then the purchaser, in addition to being the withholder, the party responsible for issuing the CFDI corresponding to the transaction. However, the fifth paragraph of this same article also states that <strong>neither the withholding nor the provisional payment will be made when the amount of the transaction is less than $227,400.00.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><em>In summary, if the car sale transaction is for an amount of less than $227,400.00 and the gain from such transaction is not greater than $118,819.08, no withholding will be made, no provisional income tax payment will be made and it will remain in its entirety as exempt income for the person carrying out the transaction.<\/em><\/p>\n\n<h3 class=\"wp-block-heading\"><strong>What are my tax obligations if I sell my house and my car, and both transactions are exempt from income tax?<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">In accordance with the third paragraph of <em>Article 150 of the Income Tax Law<\/em>, in the event of receiving this income, the annual tax return of the taxpayer receiving it must be filed, since if the amount of the annual income for any concept exceeds $500,000.00, the individual must declare it in its entirety, including the exempt income.  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>In the event that you have carried out any of the aforementioned transactions in 2023 and you are in the circumstances described above, please note that the annual tax return must be filed no later than April 30 of the current year.<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>You should be aware that there are tax obligations with respect to these operations, so we will give you some recommendations below.
